1. Acceptance of Terms

By downloading, installing, or using KidGwan ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the App.

2. Description of Service

KidGwan is a platform that helps parents and guardians coordinate children's activities, including event planning, ride-sharing, expense splitting, and group communication. The App is intended for use by adults (18+) on behalf of themselves and their children.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and truthful information when creating your account
• Keep your contact information up to date
• Notify us immediately of any unauthorized use of your account
• Not share your account with others or create accounts for third parties without their consent

4. Acceptable Use

You agree not to use the App to:

• Harass, threaten, or harm other users
• Share false, misleading, or inappropriate content
• Collect or harvest personal information from other users without their consent
• Impersonate any person or entity
• Transmit spam, unsolicited messages, or malicious code
• Violate any applicable local, state, national, or international law

5. Ride Coordination & Safety

KidGwan facilitates communication between parents to coordinate rides for children. By using the ride features, you acknowledge that:

• KidGwan is not a transportation service and does not provide or vet drivers
• You are solely responsible for verifying the identity, driving record, and trustworthiness of any driver before entrusting your child to them
• KidGwan assumes no liability for accidents, injuries, or incidents occurring during any ride arranged through the App

6. Financial Transactions

The expense-splitting and money-request features in KidGwan are communication tools only. We do not process payments directly. Any financial transactions are conducted between users through third-party services (such as Venmo). KidGwan is not responsible for any disputes, errors, or losses arising from such transactions.

7. User-Generated Content

You retain ownership of any content you post (photos, messages, event details). By posting content, you grant KidGwan a limited, non-exclusive license to store and display that content within the App for the purpose of providing the service. You are solely responsible for the content you share and must ensure it does not violate any third-party rights.

8. Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind. To the fullest extent permitted by law, KidGwan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to personal injury, property damage, or loss of data.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct we determine to be harmful to other users or the App. You may delete your account at any time from the Profile page.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We will notify users of material changes through an in-app notification.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.
